The Geological Society of America ("GSA") welcomes you to the GSA Meetings Bulletin Board ("Board"). GSA is providing you access and use of the Board as a no-cost service solely for your convenience in planning your travel and accommodation to the GSA Annual Meeting and all official GSA meetings ("Meetings"). These terms and conditions of use ("Terms") govern your use of the Board.

By clicking on the "Accept" button below, you acknowledge that you have read these Terms, understand them and agree to be bound by them. If you do not agree to any of the Terms, GSA is unwilling grant you use of the Board, and you should click on the "Cancel" button below. GSA may update or otherwise revise the Terms at any time. The Terms were last revised on: September 21, 2005. The Terms can always be found on the homepage for the Board under "Terms and Conditions of Use."

Privacy

When you register to post information on the Board, you are required to give a small amount of information, some of which is personally identifiable (e.g., email address). You are given the opportunity to provide additional information solely at your option (e.g., name, website URL, occupation, etc.) which may increase the usefulness of the Board. The information you provide when registering for access to the Board as well as all Content (as defined below) is subject to GSA's website privacy policy, which can be accessed at www.geosociety.org/privacy.htm ("Privacy Policy"). You understand and agree that through your use of the Board you consent to the collection and use (as set forth in the Privacy Policy) of this information, including the transfer of this information to the United States and/or other countries for storage, processing, and use by GSA and its affiliates.

Passwords; Accounts

You will choose a user name and password upon completing the registration process. You are responsible for maintaining the confidentiality of the password, and are fully responsible for all activities that occur under your password or account.

Use of the Board

You acknowledge and agree that all information or other materials posted on the Board by individuals ("Content") are the sole responsibility of the person from which such Content originated. By offering you access to and use of the Board, GSA is merely facilitating the posting of Content and use of Content in hopes of making your travel planning for the Meetings easier. You are entirely responsible for all Content that you post to the Board.

GSA is not responsible for your use of the Content, and recommends that you use care and diligence in investigating the quality, truthfulness and safety of all Content found on the Board before using the Content. GSA does not guarantee the accuracy, integrity or quality of such Content. You are solely responsible for all correspondence and communication arising from your use of the Board or otherwise involving or using the Content, and you are solely responsible for making all travel arrangements related to the Meetings.

GSA will use reasonable efforts to remove any Content that is offensive, indecent or objectionable, but GSA does not guarantee that such Content will not be found on the Board. Under no circumstances will GSA be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Board.

You agree that you will not use the Board to:

• post or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
• disguise the origin of any Content posted on the Board;
• harm minors in any way;
• impersonate any person or entity, including, but not limited to, a GSA official, or falsely state or otherwise misrepresent your affiliation with a person or entity;
• collect or store personal data about other users in connection with the prohibited conduct and activities set forth in this Section.
• post or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
• interfere with or disrupt the Board or servers or networks connected to the Board, or disobey any requirements, procedures, policies or regulations of networks connected to the Board;
• post or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
• post or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation, except in those areas (such as shopping rooms) that are designated for such purpose;
• intentionally or unintentionally violate any applicable local, state, national or international law;
• "stalk" or otherwise harass another.

GSA may pre-screen Content, or refuse, revise or move any Content that is available via the Board in its sole discretion. GSA shall have the right to remove any Content that violates the Terms or is otherwise objectionable, as determined in GSA's sole discretion. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Content created by GSA or submitted to GSA, including without limitation information on the Board.

You acknowledge, consent and agree that GSA may access, preserve, and disclose your account information and Content if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (a) enforce the Terms; (b) comply with the law; (c) respond to claims that any Content violates the rights of third-parties; or (d) protect the rights, property, or personal safety of GSA, its users and the public.

GSA may modify or discontinue, temporarily or permanently, the Board (or any part thereof) at any time with or without notice. GSA shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Board.

Content

You hereby grant to GSA a world-wide, royalty free and non-exclusive license to use, distribute, reproduce, modify, adapt, publicly perform and publicly display the Content provided by you on the Board solely for the purposes of providing and promoting the Board.

Indemnification, Warranties, Limitation on Liability

You shall indemnify and hold GSA, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of: (i) Content you post to the Board, (ii) your use of the Board or the Content, (iii) your violation of the Terms, or (iv) your violation of any rights of another.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

YOUR USE OF THE BOARD IS AT YOUR SOLE RISK. THE BOARD IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. GSA EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

GSA MAKES NO WARRANTY THAT (i) ACCESS TO THE BOARD WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (ii) THE QUALITY OF THE CONTENT WILL MEET YOUR EXPECTATIONS. ANY MATERIAL OR CONTENT DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE BOARD IS DONE AT YOUR OWN DISCRETION AND RISK. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM GSA OR THROUGH OR FROM THE BOARD SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT GSA SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES EVEN IF GSA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE BOARD; (ii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS, CONTENT OR DATA; (iii) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE BOARD; (iv) ANY OTHER MATTER RELATING TO THE BOARD; OR (v) YOUR USE OF ANY CONTENT. YOU HEREBY EXPRESSLY RELEASE GSA FROM ANY LIABILITY REGARDING YOUR USE OF THE CONTENT OR THE BOARD.

You acknowledge and agree that GSA has no control over such third-party websites and is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that GSA shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

Termination

GSA reserves the right to terminate your GSA account for the Board immediately upon written notice to you (including email) for any breach of the Terms.

Children

The Federal Trade Commission's Children's Online Privacy Protection Act of 1998 (COPPA) requires that Web Sites are to obtain parental consent before collecting, using, or disclosing personal information from children under 13. If you are below 13 then you can NOT use the Board. Do NOT register if you are below the age of 13.

By registering to use this forum you meet the above criteria and agree to abide by all of the above rules and policies.

Law

The Terms are governed by the laws of the state of Colorado without regard to its conflict of law provisions.
